SkyLearner provides a personalised subscription service that allows our subscribers to access courses, learning material, multimedia, text copy and questions (“SkyLearner content”) streamed and accessed over the Internet to certain Internet-connected devices such as computers, laptops, tablets and smart phones.
These Terms of Use govern your use of our service. As used in these Terms of Use, “SkyLearner service”, “our service” or “the service” means the personalized service provided by SkyLearner for discovering reading and learning from SkyLearner content, including all features and functionalities, recommendations and reviews, the website, and user interfaces, as well as all content and software associated with our service.
1. Subscription
1.1. Your SkyLearner subscription will continue until terminated. To use the SkyLearner service you must have Internet access and a SkyLearner compatible device, and provide us with one or more Payment Methods. “Payment Method” means a current, valid, accepted method of payment, as may be updated from time to time, and which may include payment through your account with a third party. Unless you cancel your subscription before your billing date, you authorise us to charge the subscription fee for the next billing cycle to your Payment Method (see “Cancellation” below).
1.2. Subscriptions to services offered by SkyLearner are voluntary and subject to the terms outlined in individual subscription agreements.
1.3. Subscribers authorize SkyLearner to use their provided contact information to communicate subscription-related updates, service announcements, and relevant content
1.4. We may offer a number of subscription plans, including subscriptions offered by third parties in conjunction with the provision of their own products and services. Some subscription plans may have differing conditions and limitations, which will be disclosed at your sign-up or in other communications made available to you. 2. Client Information Usage:
2.1. SkyLearner Aviation (“SkyLearner”) acknowledges that client information, including personal and contact details, collected during subscriptions, purchases, or interactions on the website (http://www.skylearneraviation.com), will be treated with utmost confidentiality.
2.2. The client information collected will solely be used for the purpose of delivering subscribed services, providing relevant updates, and enhancing the user experience.
3. Community Chat:
3.1. Community chat provided by SkyLearner is designed to facilitate open and constructive discussions among users.
3.2. Users are responsible for the content they post on the forums and must adhere to community guidelines, refraining from posting offensive, misleading, or harmful content.
3.3. SkyLearner reserves the right to moderate, edit, or remove content that violates forum guidelines or applicable laws.
4. Marketing Purposes:
4.1. By using the SkyLearner website, clients consent to receive marketing communications, including newsletters, promotional offers, and updates related to SkyLearner’s services.

5.1. We may from time to time offer special promotional offers, plans or subscriptions (“Offers”). Offer eligibility is determined by SkyLearner at its sole discretion and we reserve the right to revoke an Offer and put your account on hold in the event that we determine you are not eligible. Subscribers of households with an existing or recent SkyLearner membership may not be eligible for certain introductory Offers. We may use information such as device ID, method of payment or an account email address used with an existing or recent SkyLearner Subscription to determine Offer eligibility. The eligibility requirements and other limitations and conditions will be disclosed when you sign-up for the Offer or in other communications made available to you

6.1. SkyLearner may utilize cookies and similar tracking technologies to enhance user experience and gather information about website usage.
6.2. Clients can manage cookie preferences through browser settings, but disabling cookies may impact certain website features.
7. Processing of Personal and Banking Information:
7.1. Personal and banking information provided by clients during purchases and transactions on the SkyLearner website will be securely processed for payment processing and order fulfilment purposes.

12. Subscription Billing and Cancellation
12.1. Billing Cycle. The Subscription fee for the SkyLearner service will be charged to your Payment Method on the specific payment date indicated on the “Account & Training File” page. The length of your billing cycle will depend on the type of subscription that you choose when you signed up for the service. In some cases your payment date may change, for example if your Payment Method has not successfully settled, when you change your subscription plan or if your paid membership began on a day not contained in a given month. Visit our website and click on the “My Subscription” link on the “Account & Training File” page to see your next payment date. If you signed up for SkyLearner using your account with a third party as a Payment Method, you can find the billing information about your SkyLearner Subscription by visiting your account with the applicable third party.
13. Payment Methods:
13.1. To use the SkyLearner service you must provide one or more Payment Methods. You authorise us to charge any Payment Method associated to your account in case your primary Payment Method is declined or no longer available to us for payment of your subscription fee. You remain responsible for any uncollected amounts. If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not cancel your account, we may suspend your access to the service and withhold any proof of training until we have successfully charged a valid Payment Method. For some Payment Methods, the issuer may charge you certain fees, such as foreign transaction fees or other fees relating to the processing of your Payment Method. Local tax charges may vary depending on the Payment Method used. Check with your Payment Method service provider for details.
14. Updating your Payment Methods:
14.1. You can update your Payment Methods by going to the “Account & Training File” page. We may also update your Payment Methods using information provided by the payment service providers. Following any update, you authorize us to continue to charge the applicable Payment Method(s).
15. Cancellation:
15.1. You can cancel your SkyLearner Subscription at any time, but you will immediately loose access to the SkyLearner Subscription forfeiting any sums overpaid through the end of your billing period. Payments are non-refundable and we do not provide refunds or credits for any partial subscription periods or unaccessed SkyLearner content. To cancel, go to the “Account & Training File” page and follow the instructions for cancellation found in the “My Subscription” Tab. If you cancel your membership, your account will automatically and immediately become restricted, including restricting you to seeing historical training results only. If you signed up for SkyLearner using your account with a third party as a Payment Method and wish to cancel your SkyLearner Subscription, you may need to do so through such third party, for example by visiting your account with the applicable third party and turning off auto-renew, or unsubscribing from the SkyLearner service through that third party.
16. Changes to the Price and Subscription Plans:
16.1 We may change our subscription plans and the price of our service from time to time; however, any price changes or changes to your subscription plans will apply no earlier than 30 days following notice to you.
Booked Appointments & Services outside of the Monthly Subscription
17. Billing Cycle:
17.1. Any billing outside of the monthly subscription shall happen before the service takes place where possible. Should additional charges be due after the service or booking has been completed, any additional sums shall be charged to the payment card within 30 days. Where SkyLearner Deems it appropriate, it may at its sole discretion issue an invoice within 30 days for all additional unpaid sums. This shall fall due within 7 Days of the invoice being generated. Failure to settle these sums may lead to subscription termination.
18. Payment Methods:
18.1. To book services which are charged in addition to the regular subscription, you must provide one or more Payment Methods. You authorise us to charge any Payment Method associated to your account in case your primary Payment Method is declined or no longer available to us for payment of any outstanding fees as deemed due by SkyLearner Aviation. You remain responsible for any uncollected amounts. If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not cancel your account, we may suspend your access to the subscription service and withhold any proof of training until we have successfully charged a valid Payment Method. For some Payment Methods, the issuer may charge you certain fees, such as foreign transaction fees or other fees relating to the processing of your Payment Method. Local tax charges may vary depending on the Payment Method used. Check with your Payment Method service provider for details.
19. Updating your Payment Methods:
19.1. You can update your Payment Methods by going to the “Account & Training File” page. We may also update your Payment Methods using information provided by the payment service providers. Following any update, you authorize us to continue to charge the applicable Payment Method(s).
20. Cancellation:
20.1. Cancellation Varies depending on the product you are booking as listed below.
21. Online Tuition Bookings:
21.1. Online Tuition bookings are able to be cancelled or rebooked free of charge 7 days before the date of the appointment (Appointment date inclusive minus 7 Days). Cancellations within 3 Days of the Tuition shall be charged at the full 100% rate without refund unless in SkyLearners opinion the booking cannot be kept due to unforeseen circumstances. SkyLearner may be forced to cancel bookings due to operational circumstances. In this case the subscriber shall NOT be due to any compensation for any loss of income or other damages.
22. The SkyLearner Service:
22.1. You must be at least 18 years of age to become a subscriber of the SkyLearner service. Minors aged 16 and 17 may only use the service under the approval of their responsible legal parent/ guardian. It is your responsibility to ensure you meet any minimum age requirements that may be imposed on specific SkyLearner Course or content, normally due to Civil Aviation Regulations.
22.2. The SkyLearner service and any content viewed or accessed through the service are for your personal and non-commercial use only and may not be shared with individuals including those within your household. During your SkyLearner Subscription we grant you a limited, non-exclusive, non-transferable right to access the SkyLearner service and access SkyLearner content. Except for the foregoing, no right, title or interest shall be transferred to you. You agree not to use the service for public performances.
22.3. You may access the SkyLearner content in any territory where the service can be accessed, however your subscription plan must be the one intended for your country of residence or where you live in more than 1 territory, the country where you are tax resident. The content that may be available may change from time to time. You may only access the service on one device at any time, and it must be the person named in the subscription who is the person accessing the service.
22.4. The SkyLearner service, including the content and course library, is regularly updated. In addition, we continually test various aspects of our service, including our website, user interfaces, promotional features and availability of SkyLearner content.
22.5. Some SkyLearner content is available for temporary download and offline viewing on certain supported devices (“Offline Downloads”). Limitations apply, including the use of these downloads only for their intended purpose and used in an unaltered unmodified way for sole personal use by the subscriber.
22.6. You agree not to archive, reproduce, distribute, modify, display, perform, publish, license, create derivative works from, offer for sale, or use (except as explicitly authorised in these Terms of Use) content, courses and information contained on or obtained from or through the SkyLearner service. You also agree not to: circumvent, remove, alter, deactivate, degrade or thwart any of the content protections in the SkyLearner service; use any robot, spider, scraper or other automated means to access the SkyLearner service; decompile, reverse engineer or disassemble any software or other products or processes accessible through the SkyLearner service; insert any code or product or manipulate the content of the SkyLearner service in any way; or use any data mining, data gathering or extraction method. In addition, you agree not to upload, post, e-mail or otherwise send or transmit any material designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment associated with the SkyLearner service, including any software viruses or any other computer code, files or programs. We may terminate or restrict your use of our service if you violate these Terms of Use or are engaged in illegal or fraudulent use of the service.
22.7. The quality of the display and usability of the SkyLearner content may vary from device to device, and may be affected by a variety of factors, such as your location, the bandwidth available through and/or speed of your Internet connection. HD, and high bandwidth interactions and content availability is subject to your Internet service and device capabilities. WiFi or wired internet is recommended for accessing the service. Cellular networks may see a reduced diminished SkyLearner Service while incurring you the subscriber additional mobile network charges. The minimum connection speed for SkyLearner is 1.0 Mbps; however, we recommend a faster connection for improved performance and user experience. A download speed of at least 5.0 Mbps per stream is recommended to receive a user experience as intended by the SkyLearner Team. You are responsible for all Internet access charges. Please check with your Internet provider for information on possible Internet data usage charges. The time it takes to begin accessing SkyLearner content will vary based on a number of factors, including your location, available bandwidth at the time, the content you have selected and the configuration of your device.
22.8. SkyLearner software and platform is developed by, or for, SkyLearner and may solely be used for authorised access to SkyLearner content through compatible devices. This software may vary by device and medium, and functionalities and features may also differ between devices. You acknowledge that the use of the service may require third party software that is subject to third party licenses. You agree that you may automatically receive updated versions of the SkyLearner software and related third-party software.
23. Passwords and Account Access:
23.1. The Subscriber who created the Skylearner account and whose Payment Method is charged (the “Account Owner”) is responsible for any activity that occurs through the Skylaerner account. To maintain control over the account and to prevent anyone from accessing the account (which would include information on viewing history for the account), the Account Owner should maintain control over the devices compatible with SkyLearner that are used to access the service and not reveal the password or details of the Payment Method associated with the account to anyone. You are responsible for updating and maintaining the accuracy of the information you provide to us relating to your account. We can terminate your account or place your account on hold in order to protect you, SkyLearner or our partners from identity theft or other fraudulent activity.
Miscellaneous
24. Governing Law:
24.1. These Terms of Use shall be governed by and construed in accordance with the laws of the United Kingdom of Great Britain and Northern Ireland.
25. Unsolicited Materials:
25.1. SkyLearner does not accept unsolicited materials or ideas for SkyLearner content, and is not responsible for the similarity of any of its content in any media to materials or ideas transmitted to SkyLearner. Where SkyLearner seeks public or user input, thsi shall be communicated through a transparent data collection invitation process.
26. Customer Support:
26.1. To find more information about our service and its features or if you need assistance with your account, please visit the SkyLearner (Help & Resources) on our website. In certain instances, Customer Service may best be able to assist you by using a remote access support tool through which we have full access to your computer or device. If you do not want us to have this access, you should not consent to support through the remote access tool, and we will assist you through other means.
27. Survival:
27.1. If any provision or provisions of these Terms of Use shall be held to be invalid, illegal, or unenforceable, the validity, legality and enforceability of the remaining provisions shall remain in full force and effect.
28. Changes to Terms of Use:
28.1. SkyLearner may, from time to time, change these Terms of Use. We will notify you at least 30 days before such changes apply to you.
29. Electronic Communications:
29.1. We will send you information relating to your account (e.g. payment authorisations, invoices, changes in password or Payment Method, confirmation messages, notices) in electronic form only, for example via emails to your email address provided during registration.

WhatsApp. You may receive WhatsApp messages in connection with your SkyLearner account or Service and no longer wish to receive them, you can use your WhatsApp app settings to block them.
Interest-Based Ads. Interest-based ads are online ads that are tailored to your likely interests based on your use of various apps and websites across the Internet. If you are using a browser, then cookies and web beacons can be used to collect information to help determine your likely interests. If you are using a mobile device, tablet, or other browsing device that includes a resettable device identifier, then that identifier can be used to help determine your likely interests. Matched Identifier Communications. Some third party sites and apps allow us to reach our users with online promotions about our titles and services by sending a privacy protective identifier to the third party. A privacy protective identifier means we convert the original information (such as an email address or phone number) into a value to keep the original information from being revealed. The third party compares the privacy protective identifier to identifiers in its database and there will be a match only if you have used the same identifier (such as an email address) with SkyLearner and the third party. If there is a match, SkyLearner can then choose whether or not to send a given promotional communication to you on that third party site or app, and can optimize and better measure the effectiveness of online advertising. You can opt out of any Marketing Communications by clicking “Unsubscribe from this communication” on any applicable email.
You can request access to your personal information, or correct or update out-of-date or inaccurate personal information we hold about you. You may also request that we delete personal information that we hold about you. Be advised that in accordance with Civil Aviation Regulations which differ depending on the courses and content being accessed, we maybe unable to fulfill this deletion request, but shall delete the information once the minimum legal periods have passed. Example in the United kingdom we store our UK civil aviation records for 5 Years in accordance with out training manual. Please refer to the training manual in the document library for the minimum retention of records.
When you visit the “Account & Training File” portion of our website, where you MAY have the ability to access and update some of the information about your account, including your contact information, your SkyLearner Service payment information, and various related information about your account (such as the content you have viewed and rated). You must be signed in to access the “Account & Training File” section.
